摘　　要：专利侵权诉讼中,合法来源抗辩大量存在,其运用与认定,具有重要意义和价值。涉案专利侵权产品的制造者与销售者,根据《专利法》之规定,分别有着不同的权利义务,但他们的行为之间并非"井水不犯河水",而是存在着复杂的互动关系。其中,法律规定有指引作用,而对相关利害关系的计算,才是他们行为选择的关键。The identification and application of legitimate sources defense which is rich in patent infringement litigation, is of significance and value. According to the provisions in Patent Law, manufacturers and distributors involved in patent infringement, are respectively defined by different rights and obligations. Their behaviors, however, are in complex interaction. In fact, their behavioral choices are guided not only by law but also by self-interest.
