摘　　要：2015年生效实施的新版《世界反兴奋剂条例》在初次违纪禁赛期的确定、因无过失或重大过失减免禁赛期的确定、因过错之外的原因减免处罚以及其他配套处罚等问题上都有较大幅度的修改,表现出对真正的欺诈者从严处罚,对过失违纪者灵活处罚,遵循按比例原则和人权保护原则的特点,但也有对"故意"概念界定不清,证明责任设置不科学,免除未成年人证明禁用物质来源责任不合理,对"受污染的产品"的定义过宽,自首条件限制过多等问题,这些问题都需要在实施过程中等待有关机构作出进一步的解释。The new World Anti-doping Code which came into effect in 20]5 has made many changes on the sanction on individuals, including the period of ineligibility imposed for a first violation, elimination and reduction of the period of ineligibility based on fault or negligence, elimination and reduction of the sanction for reasons other than fault. The changes aim to give harsher penalty to the real cheater, to be flexible in sanction on inadvertent dopers and to be compatible to the principal of proportionality and human rights. However, the new edition does not define clearly the ＂intention＂, the burden of proof and exemption of the minor＇s burden to prove the source of prohibited substances. Moreover, it defines what contaminated product is too broadly while the conditions of prompt admissions too narrowly. All of these problems need to be explained by the relevant authorities in the execution of the code.
