摘　　要：公共图书馆对读者应负有强制缔约义务,包括强制缔约行为和强制缔约内容两个方面。赋予公共图书馆强制缔约义务是基于保障读者信息获取权、适应公共图书馆免费开放政策、保障弱势群体利益、维护平等权之需要,其效力体现在公共图书馆必须接受强制缔约规定的约束,一旦违反会构成侵权责任与缔约过失责任。The public library should bear the obligation of the compulsory contracting for readers, including two aspects： the compulsory contracting behavior and compulsory contracting contents. Giving the obligation of the compulsory contracting to the public library is based on needs of protecting the readers’ right of accessing the information, adapting to the free open policy of the public library,protecting interests of vulnerable groups, maintaining the right of equality. Its effectiveness is reflected in that the public library must accept the constraint of the compulsory contracting, once violating it will constitute the tort liability and liability for contracting negligence.
