法治中国建设视域下依法执政的基本内涵与实现途径新探

摘　　要：全面推进依法治国,加快法治中国建设,必须全面加快实施"依法治国、依法执政、依法行政共同推进,法治国家、法治政府、法治社会一体建设"的新战略。我们应当在"依法治国、依法执政、依法行政"、"民主执政、科学执政、依法执政"与"依法治党、法治政党、依法执政"三个组合中,理解和把握依法执政的基本内涵;在"加强党内法治建设、促进党内依法治理"、"有效推进依法执政,重点在于推进依宪执政"与"立足于国家根本政治制度,切实通过人大执政"三个层面上,探求依法执政的实践途径。全面推进依法治国,必须推进依法执政理论与实践的创新,加强党内法治建设和依法治理,为依法执政奠定制度基础和蓄积法治定势,将依法执政提升到依宪执政的高度并具体到通过人民代表大会执政的制度实践中。毫无疑问,这是实现依法执政、推进依法治国和实现国家治理现代化的必由之路。To fully fulfill the goal of rule by law and propel the construction of nation of law ,the new strategy of “jointly boost rule by law ,governance by law ,administration by law” and”integrating the construction of nation of law ,government of law ,and society of law” must be implemented comprehensively and speedily . We must understand and comprehend the basic connotation of governance by law by the combination of “rule by law ,governance by law ,administration by law” ,“democratic governance , scientific governance , governance by law” and “rule the party by law , party based on rule of law ,governance by law” ;and explore the practical way of governance by law based on three levels ,which can be illustrated as“intensifying the construction of rule of law within the Chinese Communist Party” ,“propelling governance by law effectively , especially focus on governance by constitution” and “starting from the fundamental political system , governing by People’s Congress effectively” .To fully propel the construction of rule by law ,we must improve the innovation of the theory and practice of governance by law , level up governance by law to governance by constitution and practice by the system of people’s congress .There is no doubt that this is the only w ay to realize the goal of governance by law ,rule of law and modernization of the country .
