摘 要:包容性增长理念虽然是对我国经济社会发展提出的新要求,作为上层建筑的法律不应该也不可能无动于衷。经济法作为国家干预经济的基本法律形式,最应该针对包容性增长理念进行基本理论和具体制度的反思和回应。具体来看,根据中共十八大报告的要求,要实现包容性增长理念,未来的经济法必须处理好促进效率与保障公平、追求数量与保证质量、体现以物为本与以人为本、推进先富与推动共富、促进国内发展与国际发展、保障发展成果增加与发展代价降低、保障增加投资与促进消费、保障形式公平与实质公平、实现惩罚功能与激励功能、进行增量突破与存量修改等具有内在逻辑关联的十大关系,做到和谐统一,从而实现包容性增长理念的目标。Although inclusiveness growth idea is in China~ economic and social development to put forward new requirements, but as superstructure law should not also cant sit by.
