摘　　要：我国法律对体育赛事类节目的保护存在漏洞与缺陷,主要表现为体育赛事直播或转播的法律性质不明确、体育赛事类节目的著作权权利归属和权利内容不确定、体育赛事类节目的法律保护存在灰色地带。为此,立法需要遵循新技术的特点,设立体育赛事转播权,并完善《中华人民共和国著作权法》中的著作邻接权制度,建立完整的体育赛事类节目法律保护体系,使体育赛事类节目这一产业链上投资的各个主体的利益能够得到妥善的保护。The legal protection on the kinds of sports programs in China exist loopholes and de- fects, mainly focusing on the legal nature of broadcasting sporting events are not clear, copyright ownership and rights content about the kinds of sports program is uncertain, the legal protection on the kinds of sports programs exist grey zone. The legislation needs to follow the characteristics o~ the new technology for this purpose, sets up the sports events broadcasting rights, and improves the relating right system in the copyright law, establishes a complete legal protection system of the kinds of sports programs, making the kinds of sports programs on the industrial chain of investment of each subjects＇ interests can be properly protected.
