民间借贷利率规制的路径选择

摘  要:对已存在24年的民间借贷"4倍利率"采取"一刀切"的管制模式,未能给利率上限以强力保护。当前,对我国民间借贷利率路径选择主要有"市场决定论"、"个案判断论"两种观点。由于市场的逐利性、自发性、盲目性并结合我国金融市场的现状,笔者认为,我国并不适合"市场决定论";"个案判断论"能够在理想状态下最大限度地实现实质正义,但鉴于我国司法资源的匮乏以及法官价值判断的主观性亦不适用;"软硬上限"是在"客观规制"的基础上发挥市场作用的利率规制方式,较适应我国不平衡的地区经济发展。我国"软上限"应坚守"4倍利率",作为强制性规范的"硬上限"高至"8倍利率"。“Four times the interest rate” of folk loan, which has existed for 24 years, now is regulated by “one size fits all”mode, which can’t give a strong protection to the interest rate limit. In the future, the main points of how to choose the path of folk loan interest rate are “market determinism” and “case judgments” .As the market is profitable, spontaneous, blind and combined with the situation of Chinese financial market,“market determinism” is not suitable for our country.“Case judgments” can ideally bring about the substantial justice to the greatest extent, but it is also not applicable because of the lack of judicial resources in our country and the judge’s subjectivity of value judgment.“Soft-upper-limit” plays an important role of the market on the basis of“objective regulation”, which is more adapted to the unbalanced regional economic development of our country.“Soft limit” in our country should stick to“four times the interest rate”, then as a mandatory standard of “upper limit”can be up to“eight times the interest rate”.
