摘　　要：在中国城镇化基础设施与公用事业中引入PPP模式是摆脱公共资源瓶颈、提高政府治理效率的重要途径。而推行该模式需要一系列的法律、政策工具作为支撑。就PPP模式在我国城镇化进程中具体应用的相关法律问题进行深入剖析,包括PPP模式的产权问题、PPP协议的性质辨析、PPP模式中私法原则对行政特权的约束、PPP项目的融资问题、PPP项目风险的合理分担、PPP运行模式以及法律纠纷的解决机制,期望为PPP模式在我国的良性发展贡献微薄力量。Introducing the PPP mode into the infrastructure and public utilities of China＇s urbanization is an important way to gel rid of the bottleneck of.public resources and im- prove the efficiency of governance. However, carrying out lifts mode requires a series of law and policy tools as sup- port. On the basis of expounding of the concept, features, classification and legal relations of the PPP mode, this paper deeply analyzes the relevant legal issues regarding the prac- tical application of the PPP mode in the process of China＇s urbanization, including .the property issues of the PPP mode, the nature ahalysis of the PPP protocol, the constraints of private law principles to executive privileges in the PPP mode, the financial issues of the PPP projects, the reason- able risk allocation of the PPP projects, the PPP operating mode and the settlement mechanism of legal disputes, which is expected to contribute its modest strength to the benign development of the PPP mode in China.
