摘　　要：行政滥用职权是当前行政权力运行过程中普遍存在的一种现象,在实践中的表现形式多种多样。正当程序原则是行政行为正当性之源,既能够对行政滥用职权起到事前或事中的监督作用,又能够规制行政权力的运行。为使正当程序原则能够对行政滥用职权发挥规制作用,必须将正当程序作为基本法治原则加以确立并完善相应的制度,同时应对违反正当程序原则的权力滥用行为进行问责。The Abuse of administrative regulation is a prevalent phenomenon of the current administrative power opera- tion,and has a variety of forms.Due process principle of administrative can play the role of advance supervision role.Be- cause of the constraint on the operation of administrative power,it is the source of administrative behavior legitimacy.The due process as the basic principle of the rule of law must establish and perfect the corresponding system and punish the abuse of power.
