西安城市管理综合执法体制改革研究

摘　　要：一个城市要实现良性运转,必须理顺城市管理综合执法体制。西安市于2005年组建了"城市管理综合行政执法局"(以下简称城管执法局),对于提高城市管理和服务水平,积累了丰富的实践经验。但同时也存在着城市管理立法滞后、管理体制不畅、执法协作体系不完善、缺乏规范有效的管理体制等问题。为此,应在构建权责一致的"大城管"前提下,加强行政立法,构建城市管理法治体系,建立城管执法人员编制增长机制,完善司法保障机制,形成综合治理体系。It is necessary for a city to realize the benign operation, strengthen the city management law enforcement system. On the basis of this, Xi＇an government has es- tablished the ＂bureau of city and law enforcement in 2005＂（thefollowing refers to Law En- forcement Bureau）,which accumulates an abundant of experience to improve the manage- ment and service level. But the problems arise abruptly; the lag of legislation; bad man- agement system; imperfect law enforcement system; the lack of standardized and effective management system. This paper shows that in the premise of the construction of the con- sistent in powers and responsibilities of ＂big city management＂, it is essential to strengthen the administrative legislation, construct management law system, establishcity manage- ment and law enforcement personnel establishment growth mechanism, and perfect the ju- dicial guarantee mechanism to form a comprehensive management system.
