摘 要:以歼10战机模型案为视角,通过分析飞机造型是否能受到著作权法保护,探析工业设计的可版权性问题。飞机造型包括线条和颜色两种表达形式,根据同一性能指标要求,飞机设计师可以设计出造型迥异的飞机,设计师对飞机造型的选择体现了其对美的感受,使飞机造型具有了审美意义,而对飞机造型的选择行为又使飞机造型具有了独创性。据此,具有独创性的飞机造型符合现行著作权法对美术作品的规定,具有可版权性。此外,尽管飞机造型具有实用性,但在理论和实践中,并未要求作品不能具有实用性,故不能因此将飞机造型排除出著作权法的保护范围。This article analyzes whether the shape of airplane could be protected by the Copyright Law and the copyrightable of industry design from the perspective of the F-10 model infringement case. The shape of airplane contains two kinds of expression forms which are lines and color. According to the requirement of identical performance indicators, airplane designers could design different shapes of airplanes. The designers embody their feelings of beauty when they decide shapes of airplanes, in which makes the shape of airplane contains aesthetic signiifcance. At the same time, the action of deciding the shape of airplane makes the shape of airplane to contain originality. Therefore, original shape of airplane conforms to the provision of the work of art in current Copyright Law, which is copyrightable. In addition, although the shape of airplane has practicability, the works hasn’t been required that it should not have practicability, in theory and practice. Therefore, the shape of airplane shouldn’t be exclude from the scope of protection on the Copyright Law.
