摘　　要：著作权默示许可制度是以效率原则和信任理论为支撑的。该制度具有以默示方式为意思表示、以默示的方式成立许可使用合同和适用于网络环境的特征。我国虽然已经有相关法律规定,但还十分不完备,需要借鉴国外相关经验,从适用范围、构成要件和著作权人权利保障等方面构建我国的著作权默示许可制度。The implied license system is supported by the principle of efficiency and the trust theory, which has characteristics including implied declaration of intention and establishment of licensing contract and applicability under network environment. Although there have been related laws and legal regulations in China on implied license system, however, they are incomplete and need to be improved with aspects of scope for application, constitutive requirements and protections for the right of copyright owners on the basis of reference from related experiences overseas.
