摘 要:为了在消化吸收现有专利技术的基础上提高新产品设计的起点,根据市场信息检索相关技术的专利,根据专利创新级别确定待规避专利的基本策略,应用发明问题解决理论方法构建待规避专利技术的原理解模型,以专利规避原则为指导,结合现有技术的优势和存在的问题,明确研发目标并将该问题定义为创新的发明问题;应用发明问题解决理论解决该发明问题,在现有技术优势的基础上开发出不同于现有技术并具有新的市场竞争力的创新产品,并申请专利进行技术保护。以完井工具封隔器为实例,进行该产品的专利规避创新设计,并申请相关专利。To improve the starting point of new production based on digestion and absorption of existing patented technology, the related technology patents were retrieved according to market information, and the patent strategy to circumvent the basic patent could be determined according to the patent innovation level. The original principle solution model of circumvented patent technology was built with Theory of Invention Problem Solving (TRIZ) meth- od. Through guidance of circumvent patent principles, the research and development objective was identified by combining with the advantage and problems of existing patented technology, and this development goal was clearly defined as an innovative inventive problem. TRIZ method was applied to solve this inventive problem which exploi- ted a new market with competitiveness as well as could be patented technology protection was developed by combi- ning the advantages of the prior patented technology. A kind of completion tool was selected as a case study, and the above innovation process was applied to packer innovation to design around the existing patent and patent related ap- plications.
