社区矫正效果的制约因素及对策研究

摘　　要：社区矫正作为一种开放型的刑罚方法,实现了对轻微犯罪人的惩罚与教育、再社会化、降低司法成本等效果。社区矫正在长期司法实践中存在制约矫正效果的因素,表现为《社区矫正法》缺位、资金不足、工作人员缺乏、居民的恐慌感、方案简单化等弊端,这些问题正在削弱社区矫正在司法实践中的效果和价值。只有尽快制定《社区矫正法》、保障资金充足、增加并规范工作人员、消解居民恐慌感、制定科学的方案才能完全实现社区矫正在犯罪预防与惩治方面的效果。As an open penalty method, community correction achieved the desired effect such as the punishment and education of minor criminal, re-socialization and the reduction of judicial cost. There are constraints in the long-term judicial practice： incomplete community correction law, under-funding and staff-short problem, oversimplification of proposal, panic of resident, which will weaken the value and effect of the community correction in judicial practice. Only when we enact a community correction law, ensure the ample capital, add extra standard staff, eliminate fears, make a scientific proposal, can we see crime prevention and punishment of community, correction.
