司法反腐的价值理念与实现路径

摘　　要：司法反腐虽属刑事司法的范畴,但有着独立于刑事诉讼的司法理念、价值功能和实现路径。中国特色的司法在反腐败斗争中具有刑罚惩戒、教育引导、建制防范、权力制约、参谋咨询和法律完善等价值功能。然而,坚持党的领导、聚焦中心任务、坚持公正司法、着眼全局全球;把握政治性、体现人民性、彰显法律性、增强科学性、适应国际性、强化示范性,是实现司法治理腐败的路径选择。Although Judicial anti - corruption belongs to the category of criminal justice, it presences independent judicial concept, the value of the function and implementation path in a criminal prosecution. In the fighting against corruption, the judicature with Chi- nese characteristics possesses some value and function, judicial punishment discipline, education and guidance, organizational preven- tion, power constraints, staff counseling and legal perfection. In order to achieve justice curbing corruption, we must choice the path which adhere to the leadership of the Communist Party, focus on the central task, insist on the fair administration of justice, consider on the world and gasp the political nature, reflect the people＇ s character, highlight the legality and enhance science, adapt to intema- tlonality and strengthen exemplary.
