论法治思维的价值诠释与应然路径

摘　　要：法治思维作为一种国家治国理政的方式,已成为全社会的普遍共识。内在结构是法治思维研究的起点问题,应遵循思维的一般逻辑层次,可分为法治认识、法治态势和习惯、法治行为模式三重结构。法治思维在法治中国建设中诠释着重要价值:法治思维是国家维稳发展之基、是维系党群关系之脉、是法治中国建设之魂。在法治中国建设背景下,公民个体加强法律知识学习和日常生活实践是形塑法治思维的主要途径;领导干部保持法律的敬畏感、树立法律信仰是法治思维形成的必要补充;而国家科学合理、公平公正落实依法治国方略,则是培育公民法治思维信心的重要保障。The thinking of rule of law, as a means of governing a country, has become the consensus of the whole so- ciety. In the study of this thinking, internal structure is the starting point, so it should be in compliance with the general logic level of thinking, which can be divided into the triple structure composed of the understanding of rule of law, the circum- stance of rule of law and conventions, and behavior patterns of the rule of law. The thinking of rule of law expounds the im- portant value in the construction of rule of law in China; that is, the rule of law thinking is the base for the development and stability of the country, the link of maintaining the relationship between the Party and the people, and the soul of the con- struction of China under the rule of law. Under the background of constructing the rule of law in China, the individual citizen＇ s strengthened learning and grasp of legal knowledge and their practice in daily life is the main way to shape the rule of law thinking; to get the leading cadres have worship for the law, and set up the legal faith is a necessary complement to the sha- ping of rule of law thinking; and to carry out the national strategies of governing the country according to law scientifically and reasonably, fairly and justly is the important guarantee for the cultivation of civic belief in the thinking of rule by law.
