国际法视角下的全球森林治理探析

摘　　要：目前森林的可持续管理还未形成具有法律约束力的全球性规范,国际上现已逐渐形成了一些国际森林规制的替代性办法,即进行全球森林治理,将全球治理的理念引入到全球森林保护中来。文章分析了全球森林治理与法治的关系,尤其是全球森林责任与正义问题,探讨了国际法视角下全球森林治理面临的挑战,最后提出全球森林治理改革的建议:建立全球森林治理机构;制定可持续森林管理的国际标准;将环境正义原则纳入全球森林治理中。Currently, there aren＇t legally binding global norms on forest sustainable management. Some alternative methods of international forest regulation have been gradually formed internationally, namely global forest governance, which introduces the concept of global governance into global forest protection. This paper analyzes the relationship between global forest governance and the rule of law, especially global forest responsibility and justice. Then it discusses the challenges of global forest governance under the perspective of international law. Lastly it proposes global forest governance reform： setting up global forest governance institution; enacting international standards of sustainable forest management; incorporating environmental justice principle into global forest governance.
