破产重整中担保物权之法律规制:限制与救济

摘　　要：破产重整既以实现债务人复兴为目标,也兼顾各利益相关者间之利益平衡。我国《企业破产法》初步建立了重整程序对担保物权的限制及其救济的规则,但应当在现行规则的基础上合理地加大对担保物权限制的力度,以确保债务人复兴之必要物质基础;同时确立对担保物权进行限制的一般适用条件以及对担保物权人利益保护的最低标准,并尽可能地给予担保物权人充分的救济,以避免对担保物权制度造成过大冲击。The corporate reorganization procedure pursuits the creditor＇s revival , and pays attention to balancing the interests of the all stakeholders as well .The regulations to limit and relieve the secured claims have been initially established in the corporate reorgani -zation procedure of the Enterprise Bankruptcy Law .But based on the existing rules the Enterprise Bankruptcy Law shall reasonably in-crease the strength of the limitation to the secured claims , and establish the general conditions applied to the limitation to the secured claims and the lowest standard of the protection for the creditors with the secured claims , and give fully relief as far as possible to the creditors with the secured claims .
