摘　　要：当代中国权利发展面临着双重文化语境,即传统社会中自然主义的亲伦文化语境和个性自由、平等法治的现实文化语境。这种双重文化语境缔造了中国权利发展话语表达的特殊方式和特殊逻辑,构成了当代中国权利发展的独特语境。构建当代中国权利发展语境的路径是,建立稳定明确的权利发展规范体系语境,建立理性、有序、和谐的权利发展的经济社会文化环境语境,增强深化权利发展的法治参与的现实程序语境和推进完善权利发展的救济制度保障语境。The development of contemporary Chinese rights is faced with double contexts, that is, the context of the traditional naturalistic household-ethic culture and the realistic cultural context of freedom, equality and legality. These double cultural contexts create the particular pattern and logic of the expression in Chinese rights development and constitute the particular context of the development of the contemporary Chinese rights. The routes to construct Chinese rights development context are as follows.- establish a stable and specific context of a standardized rights development system, build a rational, ordered and harmonious context of economic, social and cultural environment of rights development,improve the context of standardized system of rights development that law participates in and completes the context of rights development of relief system security.
