摘 要:政府购买公共服务作为一种新的国家治理模式,在国内外都得到了实践探索。但是,作为政府购买公共服务源头性和核心的边界问题却无定论。西方国家对政府购买公共服务边界一般不作确定式规定,其边界随着国家要解决的问题而发生变化。我国政府购买公共服务边界虽有规定,但仍存在指导思想异位、界定范围不清、操作性不强、立法层次太低和地域性差异考虑不周等问题,因此,必须以民生性、公共性、权力制约性和可操作性为识别因素,并通过科学立法来界定其边界问题。As a new social governance model, government purchasing public services has been studied at home and a- broad. However, there is still no agreement on the fundamental and essential problem, that is, the boundary is sues. Generally speaking, western countries have not specifically defined the boundaries but just changing with the solutions of various problems. In spite of the fact that the boundaries have been stipulated in our country, there still exist some problems such as misplaced guiding thought, unclear defining scope, weak feasibility, low legislation and inconsiderate regional differences. Hence, the definition of boundaries should be legalized scientifically and take account of identifying elements such as people's livelihood, publicity, power restriction and operability.
