新审查起诉程序实践运行状况研究——以山东省J县为样本

摘　　要：审查起诉是人民检察院实现公诉职能的一项准备工作;是对侦查活动进行法律监督的一项重要手段;是发现和纠正违法行为的必要保障。新审查起诉程序自2013年1月1日起已实施两年多,其实践运行状况基本上得到落实,但仍然存在退回补充侦查使用率偏高、考核制度制约法律有效实施、羁押必要性审查立法缺失、非法证据排除使用率偏低等问题,需要通过进一步完善补充侦查制度、羁押必要性审查制度、非法证据排除规则、提高司法队伍建设等手段进行解决。The review and prosecution in people ’s procuratorate plays an important role in proper prosecution,violations detecting and rectification of investigation activities,which is also a basic preparatory work for the implement of the public prosecution function and an important means of legal supervision of investigative activities. The new review and prosecution procedure has been put in practice for more than two years since January 1 st ,2013 ,and its implementation status has achieved the purpose of crime punishment and human rights protection,but there are always some problems,such as high supplementary investigation applicable rate,appraisal system restrict the implementation of law,necessity review legislation custody,low illegal evidence exclusion utilization rate and so on. These problems need to be solved through improving relevant systems.
