个人档案信息共享的规制措施研究——以应对档案管理数字化建设下的信息安全风险为视角

摘　　要：个人档案信息的效用能够通过共享得到发挥。在档案管理数字化建设背景下,虽然信息共享的效率有所提高,但是信息安全的基本要素——真实性、保密性与可用性等也面临被破坏的风险,共享活动的开展因而受阻。考虑到共享者很难通过自律应对这一困境,我国宜立足于档案管理与建设的实情并借鉴欧美经验,通过立法来规制共享者的行为,从而改变其任意共享信息的不良偏好,促使其在完善自身管理并确保安全的前提下进行有序的共享。立法者在按照前述思路设计相关制度时,应当一方面根据不同的信息安全要素采取相应的约束措施,如提高个人档案信息本人对共享的知情度与参与度;另一方面有区别地规制不同形式的共享,以回应它们对信息安全所带来的不同风险。The effect of readers＇ personal archives information will be taken by sharing. In settings of archives digital construction of archives management, the efficiency of personal archives information sharing is improved, while the sharing is hindered due to adventures on the key elements of information safety like integrity, confidentiality and accessibility. In order to cope with adventures, we should change the idea of focusing on information sharing promotion properly in archives law, regulate sharing and enhance management for sake of information safety in light of experience of EU and U.S. Therefore legislators should take measures responding to various elements like subject noticing and participation, in the meantime, various forms of sharing would be regulated in relevant degrees as regards to different adventures aroused by them.
