摘 要:以案例研究的方法分析施工合同纠纷产生的原因,应用项目管理理论深层次地探讨房地产项目管理中存在的问题。房地产开发公司为了实现利润最大化,采用自己开发自己施工的开发方式,存在施工合同当事人关系交错,合同实施过程中职责不清、管理混乱的问题。施工合同纠纷处理中强调证据与事实,当事人要有效维护己方的利益,就要熟悉合同法规优先顺序,配合合同价款鉴定人的鉴定调查,重视与项目干系人的正常沟通,按照法律规定举证,依据合同条款维护自身合法权益。To analysis construction contract disputes by case-study way and use project management theory to discuss the core problem in project management. The real estate business company in this case was applied a model that was developed and constructed all by itself to pursue the goal of profit maximization. However, in this model the interaction between construction contract parties were complex and construction party could not clearly define its responsibilities so as to result in messy management and a lot of contract disputes. When settling construction contract disputes, it was always emphasizing the evidence and reality. So the contracting parties must be familiar with the priority of contract laws and cooperate with survey or in the survey and pay attention to communication with all the stakeholders to safeguard its interests in management of contract disputes. The contracting parties should submit its evidence according to law and contract items.
