摘　　要：编撰经济法典包括经济法律法规按照归属于经济法部门所进行的编纂和基本经济法的撰写创制;创制中华人民共和国经济法,是编撰经济法典的题中应有之义和浓墨重彩。我国宪法规定:国家的根本任务是,沿着中国特色社会主义道路,进行社会主义现代化建设;国家实行社会主义市场经济;中华人民共和国实行依法治国,建设社会主义法治国家。现在,我们已开始实行要使市场对资源配置起决定性作用和更好发挥政府作用的改革,以完全彻底地实行社会主义市场经济,而经济法也早已列入中国特色社会主义法律体系,创制基本经济法的基本条件已经具备。创制中华人民共和国经济法,就是要创制"既是规范企业等微观经济主体的微观经济的经营、竞争行为,又是规范政府等宏观经济主体的宏观经济的经营、竞争行为,以及保障人们的消费利益,在微观经济和宏观经济领域,统一确认、设定和保护主体的劳动力权"的基本经济法。Compiling the economic codes comprises the writing of economic laws and rules that fits in the departments of eco-nomic laws as well as the writing and formulation of the basic economic laws; making the economic laws of the PRC is the inherent meaning and exclamation point of compiling the economic codes. China s Constitution has stipulated that the basic tasks of China are to go along the path of socialism with Chinese characteristics to conduct the construction of socialist modernization;to carry out the social-ist market economy;to carry out the rule by law to build a socialist country under the rule by law. Now, we have implemented to make the market play a decisive role to the resource distributions and give the government better play to the reform so as to thoroughly imple-ment the socialist market economy, and the economic laws have already been included in the socialist legal system with Chinese charac-teristics, and the basic conditions for China to make the basic economic laws have been ripe. Making the economic law of the PRC is exactly making the basic economic law to standardize not only the management and competition behaviors of micro economy for enterpri-ses and other microeconomic units, but also the macro economy for government and other macroeconomic units, to ensure people s consumption interests, to affirm, set up and protect the main parts in micro and macro areas.
