摘　　要：法治作为一种宏观的理想治国方略和社会控制形式,以其超然的魅力赢得了无数法学家孜孜不倦的努力追求。同时为了实现普遍的社会安宁与发展,必须将法治融入与其相适应的现代文明社会,作为指导社会活动的一种理念、一种原则、一种思维模式。刑事诉讼作为一种强有力的社会矛盾解决途径,在获得刑事法律有效规制的同时,更应包含朴素的善良法治精神内涵。由此,作为刑事诉讼中的重要程序,侦查需要法治土壤来结出理性之果,是为侦查法治。Rule by law, as a macroscopic and ideal strategy for administering a country and a form of social control, has charmed numerous jurists in tireless pursuit for it. For achieving universal peace and development of the society, rule by law needs to be integrated into the compatible modern civilized society, accordingly guides the social activities as a concept, a principle or a thinking mode. Criminal litigation is a powerful way to resolve social conflicts, thus it should be effectively regulated by the criminal law and contain the simple goodness connotation of rule by law. As an important process in criminal litigation, criminal investigation calls for the right soil, namely rule by law in criminal investigation, to bear rational fruits.
