国防领域功能性外观设计专利保护必要性探索

摘　　要：在我国,民用领域的科技创新成果可以申请发明、实用新型和外观设计专利,以获得保护,而国防专利只保护创新程度较高的发明专利。但国防领域一些具有特殊功能的外观设计因涉及国防利益需要保密,他们既无法申请普通外观设计专利,也无法申请国防专利获得保护。围绕功能性外观设计在国防专利保护中的必要性、迫切性等主线,探讨和论证为何要将外观设计纳入国防专利保护范畴。The innovation of science and technology achievements in civil field can be applied for invention, utility model and design patent in order to be protected in China, while in national defense field, only the invention patents with high innovation degree can acquire patent protection. However, due to the fact that some designs with especial functions concern the interests of national defense, they are strictly confidential. As a result, they can apply for neither a general design patent, nor national defense patent protection. The paper discusses and demonstrates the reason to include the design into national defense patent on the basis of the necessity and urgency of the protection of functional design in the national defense patent protection.
