农村礼治秩序和法治秩序的冲突与整合

摘　　要：随着社会转型,现代法治秩序逐步向农村社会推进,礼治秩序逐渐弱化,但礼治传统由于其顽强的韧性和历史穿透性并没有消失,而与法治秩序在农村社会呈现出一种二元冲突、融合的矛盾状态。因而,礼治秩序与法治秩序二元整合必须承认法治秩序在农村社会的主导地位,也尊重农村社会传统秩序实际情况,以上下互动方式来实现农村社会秩序法治化。With the social transformation, the order of rule of modern law gradually is advancing into the rural society, and the order of etiquette governance gradually is weakening. However, the order of traditional etiquette governance doesn＇t disappear since its strong toughness and historical penetration, which contradicts the order of rule of modern law in the countryside. Therefore, the conformity of the order of etiquette governance and the order of rule of law must not only admit that the order of rule of law is dominated in the countryside, but also respect the fact of traditional order in the countryside. Only through the way of the upper and lower interaction can we realize the rule of law in the countryside.
