开发区管委会法律地位问题研究

摘　　要：我国的国家开发区作为社会主义市场经济的实验区和试水区,推动了我国的改革开放,其管理体制具有过渡性特点。我国开发区的经济发展一直保持着高速发展的态势,并形成了适用于不同区域的各具特色的管理体制。但开发区管委会作为开发区的管理机构,其法律地位的不明确在一定程度上制约了开发区经济的发展,使得开发区综合改革的功能出现了异化。如何准确界定开发区管委会性质,构建可促进开发区经济社会可持续发展的新的管理体制,是亟待解决的问题。建议将开发区管委会定位为地方政府的派出机关,继续强化开发区的综合体制改革,保持开发区的体制优势。As the experimental area of the socialist market economy, the National Development Zone of China has promoted the reform and opening up of our country and has the transitional features of its management system.The economic development of development zone has maintained the trend of the high speed development and has formed the characteristic management system which is suitable for differ- ent regions. But as the administrative office of the development zone, the legal status of administrative committee is not clear in a certain extent . It will limit economic growth. How to define the nature of the development zone and construct the new management system which can promote the sustainable development of the economic and social economy is a problem to be solved urgently..The proposed develop- ment zone is located in the local government agency, I advice continue to strengthen the comprehensive system reform, and maintain the institutional advantages of the development zone.
