行政法视角下的不动产登记制度——兼评《不动产登记暂行条例》

摘　　要：建立不动产统一登记制度,是国务院机构改革和职能转变的重要内容,是提高不动产交易效率和安全性的必要之举,也是完善社会主义市场经济体制的必然要求,对保护不动产权利人合法权益、提高政府治理效率具有重要意义。相关的法律中有关不动产登记的不同规定,应当尽快随之配套修改,做好各项规定的衔接。登记机构的职责还应进一步细化与明确,将不动产统一登记制度整体性纳入简政放权的进程中。Establishing a unified registration system of real estate is an important part of the institu-tional reform of the State Council and the functional transformation,which is to improve the transaction ef-ficiency of real estate and security necessary to move,but also improve the inevitable requirement of the so-cialist market economic system.This system have important significance to protecting the legitimate rights of real estate holder and improving the efficiency of government governance.The relevant laws and regula-tions on the registration of real estate shall be amended as soon as possible,and the relevant provisions shall be made as soon as possible.The duties of registration authorities should also be further refined and clear,and incorporate the real property registration system as a whole into the decentralization process.
