非法证据概念辨析及其排除范围界定

摘　　要：非法证据排除规则中的非法证据是狭义上的非法证据,即通过违法手段获得的证据。这种非法证据大多都具有关联性,也可能具有客观性。但无论非法证据是否具有客观性和关联性都应当予以排除,既不能作为最终裁决的依据,也不能作为各个诉讼程序节点的依据。非法证据的排除范围从证据存在形态上和表现形式上,可以归纳为非法言词证据和非法实物证据。言词证据一旦被认定为非法证据就应在各个诉讼环节予以排除。非法实物证据排除的对象应作广义理解,不仅仅包括书证、物证,其他如视听资料、电子数据等被界定为非法证据的也应排除。实物证据分为合法证据、瑕疵证据和非法证据。其中瑕疵证据有两个走向,能够补正或作出合理解释的转化为可用证据,否则转化为应当排除的非法证据。Illegal evidence of illegal evidence exclusion is a narrow sense, namely the evidence obtained through illegal means. This illegal evidence has relevance, may also have the objectivity. But regardless of whether the illegal evidence has the objectivity and relevance should be excluded, neither as a final ruling basis, also can be used as the basis of each procedure node. Illegal evidence exclusion range from the evidence for the existence of form and the form of expression, can be summed up as the illegal evidence and illegal physical evidence. Verbal evidence once identified as illegal evidence which should be ruled out in every link of the legal proceedings. Object the illegal physical evidence exclusion should be understood in a broad sense, including not only the documentary evidence, material evidence, other such as audio-visual materials, electronic data is defined as the illegal evidence should also be excluded. Physical evidence is divided into legal evidence, the defective evidence and illegal evidence. The defective evidence has two orientations, change can make corrections or to make a reasonable explanation for the evidence available, otherwise it into illegal evidence should be excluded.
