学校体育伤害事故中赔偿主体的确定路径

摘　　要：依照现行法律法规的规定,学校体育伤害事故承担责任的主体通常是学校、教师或加害第三人。让学校和教师承担赔偿责任,无形中增加了学校和教师开展体育活动的压力,阻碍了校内外体育活动的健康发展。如果是加害第三人赔偿的情况,权利人能否得到赔偿,则会受第三人自身的经济状况等因素的限制。如果借鉴国外经验转移风险,将现有的赔偿义务主体转变为保险公司、体育伤害赔偿基金会共担风险的局面,则有利于受害人及时得到救助,有利于学校体育活动的正常开展。In accordance with the provisions of the current laws and regulations, the school sports injury liability is usually on school, teachers or the infringer. Bearing the liability for compensation, schools and teachers virtually are under greater pressure to carry out school sports activities. If the infringer will shoulders compensation, whether the injured side can get the compensation will be restricted by the factors such as the third party~ own economic condi- tions. If we learn from foreign experience and transfer the risk, making insurance companies as the compensation duty main body or share the risk with sports injury fund, it will be conducive for the victims to receive timely assis- tance, which is beneficial for the normal development in school sports activities.
