摘　　要：海运业是社会经济发展的重要基础产业。为提振行业发展,破解航企困局,2014年9月3日,国务院印发《关于促进海运业健康发展的若干意见》。这是我国建国以来第一次把海运业发展上升为国家战略。完善的法律法规体系,健全的航运竞争法律制度是营造公平竞争航运环境的基本保障。本文梳理了目前中国航运法律的基本体系框架,重点分析航运竞争法律制度存在的问题,探讨航运反垄断法与航运反不正当竞争法律制度的构建与完善。Shipping has always been the fundamental industry for social and economic development. With regard to promoting shipping and helping the industry breaking through, the State Council promulgates Several Opinions on Promoting the Healthy Development of Shipping Industry on September 3, 2014. This is the first time that shipping development has been upgraded as a national strategy since the founding of PRC. A harmonious system of laws and comprehensive shipping competition legal system is the basic guarantee of a fair competitive shipping environment. This essay combs the present framework of China＇s shipping law, emphasizing the problems existed in shipping competition legal system and probing the construction as well as improvement of Shipping Antimonopoly Law and the Shipping Antimonopoly Law.
