英、德再保险监管模式借鉴性分析

摘　　要：通过分别列举英国非劳合社市场、德国的再保险监管范式,结合2009年《保险法》和相关法规下中国再保险监管现状,对英、德再保险监管范式进行批判性吸收,提出五个政策建议。在构建再保险监管框架的进程中,各国监管者都力求在再保险可获得性与再保险安全性之间寻求一个符合本国发展实际的"刀刃上的"平衡。探究在直、间接监管方面的代表国英国、德国的再保险监管范式,以更好地谋求我国再保险业和原保险业的整体协调和长足发展。The article mentions the regtdation paradigm of German and British reinsurance market （excluding the Lloyd＇s） respectively and considers fully China reinsurance regulation situation under the Insurance Law （2009） and the like. It critically absorbs British ＆ German reinsurance paradigm, leading to 5 suggestions. In the process to build reinsurance regulation framework, regulators from all nations are endeavoring to find an on- the-blade balance between obtainment and safety, which is also suitable for the actual development. Exploring the 2 paradigms, we demand the overall coordination, and long-term development of both reinsurance industry and insurance industry.
