我国未成年人监护制度的缺陷及对策思考——以新疆未成年人犯罪为视角

摘　　要：从新疆未成年人犯罪现状透视我国未成年人监护制度,主要存在现行未成年人监护制度不适应社会形势的发展,监护人主体资格规定不具体,缺乏可操作性,没有相应的监护监督保障机制等问题。应建立强制举报制度、追责制度、帮扶制度及国家监护制度,最大限度的保护未成年人人身、财产及其他合法权益,从而更加有效地预防和减少未成年人犯罪,促进社会的和谐稳定。Through the analysis of nonage crimes condition in Xinjiang and nonages＇ guardian system in our country, we can find that the system is not adapt to the development of social situation, the qualification of guardian corpus has no definite rule, maneuverability, and corresponding guarantee mechanism etc. We should build up the compulsorr report system, track for responsibility system, helping system and national guardian system, in utmost protect nonages＆#39; personal, property and other legal rights, so as to prevent and decrease nonage crimes and promote the harmonious stability of society.
