摘　　要：恐怖主义的内涵随着国际形势的发展而不断演变,各国在如何界定恐怖主义方面始终未能达成一致,争议之一便是恐怖主义是否适用于民族解放运动。近年来,恐怖主义愈演愈烈,国际恐怖主义成为国际公约、区域性公约和安理会的决议规制的对象,在联合国安理会层面,国际恐怖主义已经被视为国际罪行。尽管国际公约规制的犯罪行为并非一定就是主权国家行使普遍管辖权的国际罪行,但是国际恐怖主义应当被认定是国际罪行,并且主权国家应对其享有普遍管辖权。在我国,为了应对国内的暴力恐怖事件,制定《反恐怖主义法》势在必行。如今《反恐法草案》的二审稿在原有的基础上做出了修改和完善。本质上这部《反恐怖主义法》属于公共治安法。它立足于防范和打击恐怖主义,有利于更好地维护国家安全、公共安全和人民生命财产安全。The connotation of terrorism is evolving with the development of international situation, each state have not been agreed in the aspect of how to define the terrorism, one of the controversy is whether terrorism should be applied to the national liberation movement. In recent years, terrorism has dramatically intensified and international terrorism has became the object of the regulation in international convention, regional convention and United Nations Security Council resolution, the international terrorism has been viewed as an international crime from the perspective of United Nations Security Council. Although the crime regulated by the international convention is not necessarily an international crime over which a sovereign state ean exercise universal jurisdiction, the international terrorism should be regarded as international crime, and sovereign state shall render its universal jurisdiction. It is imperative to draft the anti-terrorism act in order to deal with terrorist violence in China. Now the second review version of the Draft of China＇ s anti-terrorism Law has been modified and perfected based on the original one. The essence of the ＂Anti-Terrorism Law＂ belongs to public security law. It is based on preventing and combating terrorism so that to better safeguard national security, public security and people＇ s safety of life and property.
