“依法管档”研究的主要内容、特征及问题分析

摘　　要："依法管档"研究的主要内容与特征可以概括地表述为"依法管档"含义丰富,但专指性较弱;在相关文献中提及者众,论及者寡,专论者无;"依法管档"多与"依法治档"同时使用,均被视为档案部门的职责与任务;"依法管档"广泛运用于各行各业;强调"依法管档"需要法制观念与法制思维。同时,"依法管档"在研究与实践中也存在一定的问题,即"依法管档"及相关词组没有明确的界定,使用随意;《档案法》被赋予了法律之外的期望;更多地强调行政执法与行政执法权;寄期望于通过宣传教育提升全社会的普遍守法意识,这应当引起我们的重视。此外,为便于今后研究的开展,文章对"依法治档"、"依法管档"和"依法用档"三个概念做出界定。The main contents and characteristics of the study on managing archives upon the rule of law can be broadly described as five areas： rich in meaning, but poor specificity; referred to by the public, so few deals, and no monographs in the relevant literature; be used simultaneously with ＂administering archival affairs upon the rule of law＂, and regarded as archives of responsibilities and tasks; used widely in all walks of life; Stressing that legal concept and legal thinking needed by ＂managing archives upon the rule of law＂. At the same time, there are some problems for the ＂managing archives upon the rule of law＂ in research and practice, such as ＂ managing archives upon the rule of law ＂and related phrases were not clearly defined, and the phrase was free to use; the ＂Archives Act＂ was given the expectations outside the law; the archival departments put more emphasis on the administrative law enforcement and administrative law enforcement; The archival departments expect through publicity and education to enhance the society＇s universal law-abiding consciousness. The above-mentioned issues should arouse our attention. In addition, the article defines the ＂administering archival affairs upon the rule of law＂. ＂Managing archives upon the rule of law＂ and ＂Using archives upon the rule of law＂ to provide the convenience for the future research.
