中央与地方社会保障事权配置法治化的比较研究

摘　　要：文章通过分析国内外社会保障事权纵向配置的异同,得出应以国家制度、规范作为研究突破口。进而述论我国社会保障事权配置相关的国家立法,集中描述了中央与地方政府该项事权配置的法治现状。考察与比较研究美国、英国、日本、意大利、比利时等国外关于社会保障配置的法律文件,获得宪法规定、法律授权、命令授予三条法治化途径与域外关于中央与地方事权配置的法治经验。The paper analyzed the similar and difference of social security governance between China and foreign countries,concluded that we should take national institution and rules as a entry point of research. The paper expounded national laws relate to social security governance,and elaborated governance situation between local and central government. After comparative researches on relative laws of U. S. A,Britain,Japan,Italy and Belgium,The paper deemed that there are some experience for reference and three legal paths to realize,e. g. confirmation of the Constitution,law authorization and administration permission.
