摘 要:我国现行《矿产资源法》过分强调政府管制,私权在市场资源配置中的地位没有得到发挥。我国修订《矿产资源法》应以矿产资源国家所有权为基础,区分国家作为矿产资源所有者与作为勘探开发管理者的身份;突出采矿权在《矿产资源法》中的中心地位,使采矿权出让金与税各得其所,实行采矿权登记制度,用安全生产许可证吸收采矿权许可证,实现不同采矿权主体市场地位的一致性,明确探矿权向采矿权转化的路径;还应明确规定矿产资源开发造成的生态损害的民事救济措施,且恢复原状具有优先适用性。The current"the Mineral Resources Law(MRL)"emphasis on government regulation too much,and private rights don't gotten to play in the allocation status of market resources.The revision of MRL should be based on the state ownership of mineral resources,and should distinguish between countries as the owner of mineral resources and manager of exploration and development.The mining right is the core in circulation system of the mineral resources,transfer fee and resources tax of the mining right should be properly placed,the mining right registration replaces mining licenses,and merges the mining license and safety production license to one certificate,and implements different body to consistent position,and legislation should clear the method about the right of exploration converting to the mining right.We should build up the civil remedies about the ecological damage in the legislation,and restoration is precedent.
