摘　　要：祭奠纠纷案例判决书基本上是按"法内论证+法外论证"结构去论证,分别承担着判决书的"讲法说理"功能。其中对法外伦理性资源的修辞论证尤为显著,通过对伦理性资源在判决书中的各种修辞方法的运用,使判决书的正当化建立在合法性与合理性基础之上。家庭伦理性案件中的"情理"因素与修辞论证之间存在着特殊的依存性关系。基于此,应重视对家庭伦理性案件中"情理"要素的修辞论证,努力实现此类案件判决书的论证达到尽善程度。Memorial dispute case verdict is basically proved according to ＂law demonstration and extrajudicial reasoning＂,sharing the＂law and reasoning＂function of the judgment.The rhetorical argumentation on the outside of the law ethics resources is especially important.Using various rhetoric approaches in the judgment of ethics of resources,the verdict is established on the basis of legitimacy and rationality.There is a special relationship between＂reasonable＂factor and rhetorical argumentation in family ethics cases.We should attach importance to the rhetorical argument in the family ethics case.
