社会组织在国家治理现代化中的积极作用——广州市非法组织标准之评议

摘　　要：社会组织在国家治理体系中占据重要一环,是国家治理从"自治"、"互治"到最终实现"善治"的重要途径。社会组织可以激发社会的活力提高应对危机的水平,将公民参与国家治理的途径合法化,有效提升国家治理能力。社会组织能够协调相互背离甚至冲突的利益,并在一定规则的基础上实现多元主体的良好互动和互相协作,共同克服政府管理"失灵"的世界性政治难题。广州市政府颁布的《广州市社会组织管理办法》总体上非常有改革精神,一定程度上代表了我国社会组织法律制度未来的改革方向。但当前《广州市取缔非法社会组织工作细则》(征求意见稿)中非法组织标准仍显保守,有待进一步改革。Social organizations occupy an important part in the national governance system, which is the important way to achieve autonomy governance, mutual governance till the ultimate realization of sound governance. Social organizations could stimulate social vitality and respond to the crisis, and legalize citizen participation in the way of national governance, and finally improve the national governance capacity. Social organizations could also coordinate the conflict interests of different groups and realize mutual coopera-tion of multi-subjects on the basis of certain rules to solve government management failure which is a world political difficulty. The“Guangzhou Social Organization and Management Approach” promulgated by Guangzhou municipal government is based on the spirit of reform and represents the reform direction of the social organization law system in China. However, it is unfortunate that standards of the current “Guangzhou Banned Illegal Social Organization and the Working Rules of the Illegal Organization （ Draft）” are still conservative and need further reform.
