摘 要:建设21世纪海上丝绸之路是深化中国与亚非欧国家地区间合作、打造命运共同体的重要战略构想。从海运贸易角度来看,由于沿线国家存在着海事法律冲突并且缺失配套的区域性统一海商实体法以及海事国际私法制度,丝绸之路建设面临着法律风险与挑战。以区域经济一体化与法律一体化为视角,在进一步完善中国与沿线各国间法律协调机制的基础上,针对涉外海事关系法律适用问题提出创设区域性统一国际私法典以及构建由我国主导的区域性统一海商法律体系的对策。The construction of the 21st century Maritime Silk Road is a significant strategic concept to deepening cooperation among China, Asian,African and European countries and making a community of destiny. From the perspective of shipping trade, because most countries along the route exist conflicts of maritime law and there is no matched unified maritime substan- tive law as well as a system of maritime private international law at the regional level, the construction of Silk Road faces legal risks and challenges. From the perspective of regional economic integration and legal integration, on the basis of perfecting le- gal coordination mechanism among China and other countries, this paper puts forward effective countermeasures regarding the issues of application of law on foreign-related maritime relations, which are to create regionally unified private international law code and build regionally unified maritime legal system dominated by our country.
