摘　　要：本文从谷歌数字图书馆案件的判断标准谈起,介绍了美国和我国著作权合理使用制度的不同规定,研究了著作权合理使用制度的理论背景,并对我国当前的著作权法第三次修改和如何建立适用于我国图书馆界著作权合理使用制度提出了建议。This paper introduces some difference of copyright fair use in America and China, studies the theoretical background of the copyright fair use based on Google Library case. The author throws out some suggestions on the third revision of the copyright law of China and how to establish a suitable fair use system of copyright for libraries in China.
