摘　　要：随着云计算的发展,云计算技术开始应用于IPTV行业,IPTV运营商结合云计算技术不断推出新型服务模式,较易侵犯他人版权。其中,"回看"模式和国外Cablevision案以及Optus案被告提供的云服务模式具有一定的相似性,从版权角度对"回看"模式的法律性质进行分析,可以认定"回看"模式提供未经授权作品的行为在我国侵犯了版权人的信息网络传播权,但实质侵害不大。IPTV运营商在推出新型服务模式前应进行法律分析以规避法律风险。As cloud computing develops,IPTV industry starts with the application of cloud computing. The IPTV operators launched new services constantly which made some new infringement problems. The time-shifting mode is similar to the foreign cloud services,especially the case happened lately. This paper will explore and analyze the concepts and technological features of IPTV time-shifting mode by comparing them. We conclude that if the works provided by timeshifting mode are unauthorized,it may infringe upon the right of communication through information network. The IPTV operators should analyze the legal risk before they apply the new mode.
