摘　　要：马克思对资本主义正义观的批判是马克思理论中至今仍未过时但往往被人忽视的重要理论成果之一。我们要探讨马克思对资本主义正义观所作的一系列批判,无可置疑的首要问题是要找到他对资本主义正义观进行批判的逻辑起点。同时,我们如果要真正做到用唯物主义历史观的眼光去看待和分析问题,对于这一逻辑起点当然应该回到马克思生活的那个时代去寻找。马克思认为,资本主义的分配正义建立于所谓基于自由平等的交易正义基础之上。这种自由平等的交易正义在资产阶级看来理所当然地包括劳动力的自由交易。一旦剥掉了蒙在劳动力的自由交易这一资本主义基本行为方式身上的"平等"的漂亮外衣,我们看到的只有赤裸裸的非正义。马克思对资本主义分配正义进行了更深入、更彻底的批判,其特别集中的焦点是在所谓市民权利和政治权利的对革命的解释性作用上。马克思对资本主义正义观的批判中蕴涵着一个根本的价值指向,这就是人类社会只有通过变革生产方式,首先实现人的真正解放,才能最终实现人们所追求和向往的正义。Although usually neglected, Marx＇ s criticism of capitalist justice concept is one of the important theoretical achievements of Marxist theory which still hasn＇ t been out of date.In order to discuss Marx＇s series of criticism of capitalist justice concept,undoubtedly the primary problem is to find his logical starting point of criticism of capitalist justice concept.At the same time,in order to truly treat and analyze problems with historical materialism, this logical starting point should be found in the era of Marx＇s life.Marx thought the distributive justice of capitalism is based on so-called liberal equally trade justice.It seems to the bourgeoisie this liberal equally trade justice naturally includes the free trade of labor.Once the beautiful coat of ＂ equality＂which covered the free trade of labor as a basic behavior is revealed,what＇s exposed is bare injustice.Marx criticized capitalist justice concept more deeply and thoroughly, especially concentrating on so-called civil right and political right＇ s explanatory function to revolution.There lies a fundamental value direction in Marx＇s criticism of capitalist justice concept,that only by changing mode of production and realize the true liberation of the people at first, can justice pursued and yearned by people be achieved eventually.
