摘  要:1923年《商标法》颁布之前的清末民初,我国民商事活动仍然处于商标制定法缺失时期。从当时国内商标牌号的一些纠纷诉讼案及其裁判、处罚情况,可以看出清末民初我国商民的商标法律意识的一些特点:商标专用权意识薄弱;对商标侵权的内涵界定认识不清;商标注册意识淡薄;对商标的保护和对商标纠纷诉讼的裁判、处罚仍摆脱不了传统行为方式和商业惯例的影响等等。这些特点是由于我国长期以来缺少对知识产权的保护,商民商标法律意识、观念的形成与提升滞后于商标法制建设本身所致。这些情况又进而降低了《商标法》实施的实际效果。The period of the late Qing dynasty and the early Republic of China before 1923 when the Trademark Act was issued was still a period lack of legislation of trademark laws in civil commercial activity.Based on the dispute lawsuits concerning the trademarks and brands in China at that time as well as their judgments and punishment,features of legal awareness in trademarks then can be concluded as weak awareness of exclusive right to trademark use and of trademark registration,implicit knowledge on the connotative definition of trademark infringement.Trademark protection and judgments and punishment of the trademark lawsuits were greatly influenced by traditional behaviors and business practices.All those features originate from the lack of intellectual property protection,along with the forming and upgrading of the legal awareness and concepts concerning trademarks lagging behind the legal construction of trademark,which reduces the actual effect of Trademark Act implementation.
