摘  要:土地经营权是流转情况下才独立于承包权的一项权利,是对农地流转实践的政策回应,其性质应是债权,不是物权。国际上,将与土地经营权较为类似的租赁权性质界定为债权并进行物权化,是多国通行做法,目的是平衡权利关系。应厘清现有土地流转方式,进一步稳定土地流转关系,继续做好土地经营权流转市场发育的相关工作,做好相关政策对接与储备。Land management right was a right independent of land contract right when it was transferred. It was credit right, not real right. Internationally, it was a common practice in many countries which define the leasehold as credit right. It aimed at balancing the relationship of the rights. The ways of existing land transfer should be clarified, the transfer relationship should be further stabilized, the market of land management right transfer should be developed continuously, and related policies should be joined and stored for further use.
