民国时期中医药讼案医疗鉴定探析

摘　　要：民国时期医患关系日趋紧张，因各种医疗纠纷而导致的中医药讼案经常发生，由此产生的医疗鉴定问题成为医界和司法界关注的焦点。民国中医界重视医疗鉴定权，反对由西医单方主导医疗鉴定，通过由职业团体、学术团体、医学院校等主体设立各类鉴定机构，力争保证医疗鉴定的专业性和客观性，不断提高鉴定水平。Since the doctor-patient relationship was increasingly tense during the Republican period, Chinese medical lawsuit cases happened frequently due to various sorts of dispute, and had become the focus in both medical and judiciary fields. During this period, the Chinese medical professionals were highly concerned about the rights of medical appraisal and opposed the appraisal made only by western medical professionals alone. Through the establishment of various sorts of appraisal units by professional community, academic groups, and medical colleges, endeavor were made to improve the appraisal level of professionalization and objectivity.
