摘　　要：大数据时代,人类生活的现实场景与网络虚拟空间通过数据结合得愈加紧密,人类生活在现实场景和虚拟空间同步进行。大数据的应用在改变了人类生活同时,也对刑事立法和司法产生了深刻影响。信息数据自身的价值属性增加了数据受到侵害的刑事风险,对传统刑法网络犯罪与计算机犯罪的规范体系造成了严重冲击。在风险刑法的思维导引下,如何应对大数据时代网络犯罪,实现传统刑法规制体系的完善。因而应当以"大数据"为指导理念,立足数据为基点对相关罪名予以完善,推动大数据刑法规范体系的成熟完善,回应时代发展,实现更好的规范供给。In the era of big data, people's real life and cyber space become more closely connected, and even happen simultaneously. The application of big data not only changes human life, but also impacts criminal legislation and justice. The value of information and data brings about security risks, which poses great challenges to traditional cyber-criminal law. Under the thinking of criminal law against risks, how can we deal with cyber-crime in a big data era to improve traditional criminal regulation system? As a result, criminal law should take 'big data' mentality as the guiding philosophy and perfect rules for related offenses to promote a sophisticated big data criminal law system and provide legal support for the development of the times.
