创设准公益性专利交易机制研究

摘　　要：准公益性专利交易指兼顾营利性与公益性等双重效果的专利交易行为。其宗旨、资金来源、机构性质、收费方式、评价方式及其评价指标与协调难易程度等方面具有特殊性。本研究建言以交易费用理论与利益平衡理论为制度基础,打造特色专利银行,汇聚布局型与反诉型专利,形成开放会员模式的基金招募等专利运营模式,设置布局型与反诉型专利基金,创设准公益性专利交易机制。Quasi commonweal mechanism of patent trading refers in particular to the kind of patent transaction, whose dual-effect in- cludes both for-profit and social profitability. Compared with nonprofit and for-profit of patent trading, quasi commonweal patent trading is very special in its purpose, source of funds, institutional, charging methods, evaluation methods and evaluation index and degree of coordination etc. Based on the transaction cost theory and the balance of interests theory, this study suggests that we had better create the special patent bank, bring both the layout type and counterclaim type patents together, and create the patent business model, which is to form the fund prospectuses and the open membership model, then set both the layout type and counterclaim type patent fund. In the end, the paper tries to create the quasi-welfare patent trading mechanism.
