国际海底生物资源保护问题研究——基于《联合国海洋法公约》的分析

摘　　要：国际海底生物资源是近年来引起国际社会高度重视的海洋生物资源,但其法律属性和保护机制并没有得到明确的规定。文章立足于对《联合国海洋法公约》进行分析,认为现行海洋法体系并未能对国际海底生物资源提供有效的保护。公约在保护国际海底生物资源问题上概念界定的缺失、管理机制的缺陷、保护工具的缺乏,说明现行保护机制的不足之处。为了有效保护国际海底生物资源,应当明确国际海底生物资源在海洋公约上的概念,完善国际海底管理局的管理机制,在国际海底建立保护区。Based on the analysis of the Convention on the Law of the Sea, the paper holds the view that the current system on the law of the sea fails to conserve the biological resources in the international seabed effectively. After analyzing the shortcomings of the convention on the law of the sea on the protection of the seabed biological resources, such as lacking precise notion, effective administration system and conservation tool, the paper illustrates the disadvantages of the current conservation system. For conserving the seabed biological resources effectively, international community should define it clearly on the basis of the law of the sea, perfect the administration system of the International Seabed Authority and establish protected areas in the seabed.
